Torfaen County Borough Council wishes to appoint a suitably qualified and experienced contractor for the operation management and transportation services of their Household Waste Recycling Centre/Transfer Station at Panteg Way, New Inn,Pontypool within the Borough of Torfaen.
Household waste delivered to the site by householders is to be received and arrangements made for separating and segregating the waste into recyclables and non recyclables. The waste streams are to be properly stored in a secure manner whist awaiting haulage for reprocessing and/or treatment. A van permit is in operation at the site and the contractor must ensure compliance with this.
The Contract is initially for the duration of seven years with the option to extend on an annual basis subject to satisfactory performance and maintenance of reasonable costs up to an additional three years.
The authority is looking to contract with only one service provider who would be managing the sites and responsible for the sorting of the materials. The authority will allow sub contracting under this arrangement by prior agreement only.
Operation and Management of Torfaen County Borough Council Household Waste Recycling Centre (HWRC) and Waste Transfer Station
The contract will cover Provision of management; day-to-day operation including recycling and recovery services at the site. Including for routine maintenance and transportation of specific contract Waste streams from the site to Council’s nominated final disposal facilities and Waste Transfer Station and to nominated and/or agreed Reprocessing Facilities.
The Service will also be responsible for the overall cleanliness of the facility and opening and closing each day.
Positive interaction with customers to the facility is a key part of its operation, as is the consideration for disabled users.
There may be a TUPE requirement in relation to this contract.

The above lists the minimum requirements of the Authority.
The authority is keen to apply the principles of the Waste hierarchy and will be seeking proposals relating to the HWRC’s to include: -
- Acceptance of Trade Waste on the sites
- Theft control
- Acceptance of additional waste streams as and when markets are available.
- Contract incentives
- Employment of “residual waste monitors”
- Maximising reuse of waste materials
Community Benefits will apply to this contract.
Under the terms of this contract the successful contractor will be required to deliver Community Benefits in support of the authority’s economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations
Accordingly, the requirement to do so will be part of the award criteria for this tender as a core requirement. The successful contractor will be expected to consider opportunities to recruit and train long term economically inactive persons as part of the workforce delivering this project, and contractual obligations and/or performance indicators may be introduced to this effect.
An Official Journal of the European Union (OJEU) restricted procurement process will be undertaken in accordance with EU Procurement Directives and the Authority’s Standing Orders for Contracts.

It is estimated that the site will handle a minimum of 30,000 tonnes of waste per annum. The tonnage quantities are given as guidance only. Torfaen County Borough Council will not guarantee minimum or maximum tonnage quantities as part of this contract.
The breakdown is as follows for both the HWRC/Transfer Station for 2013.
HWRC - 3600 te recycling, 1,400 te rubble, 2,500 te residual waste
Transfer Station - 24,700te residual (including the 2,500 te HWRC Residual), 1900te street Sweepings, 3,300 te green waste, 2,100 food waste.
Total waste handled at the site = 37,000 tonnes.
Please note the transport, treatment and disposal of residual, food and green waste is carried out by separate contractor further details will be provided at the next stage and within the invitation to tender.
However, for the purpose of this contract you will be expected to manage the transfer of all of the waste streams.

The HWRC recycling rate for 12-13 was 60.6% up from 48.3% in 11-12. This figure is a like for like figure and excludes rubble. However the Welsh Government now also includes rubble in their calculation. As a result HWRC recycling rate for 12-13 was 68.25%, and 61.8% in 11-12.
The authority requires that the site reach a minimum of 80% recycling over the term of the contract.
The site receives all waste from the councils refuse collection vehicles, street sweepings and gully waste including food, green and residual waste, street scene vehicles, including, fly tipped material and bulky collections.
Some hazardous waste found fly tipped around the County Borough such as gas bottles, fridges and plasterboard is also delivered to the sites by the Authority.

The Authority will use the D.U.N.S. number to obtain a D&B “failure score” taking into account the “risk indicator score” and “financial strength code”. The thresholds set are as follows: “risk indicator score of 1, 2, 3” and “financial strength code of

The Authority will only select a contractor to tender if it holds Employer’s Liability and Public Liability insurance to the value of £10 million or above (as required by legislation) from a reputable provider with appropriate financial strength or undertakes to put it in place before a contract is awarded (if successful)and provides satisfactory evidence as required in the PQQ.
Contractors must meet the minimum financial threshold as set out in the pre
qualification questionnaire (PQQ). Contractors who fail to meet the minimum
financial threshold will be excluded from further consideration and their tenders will not be evaluated by application of the selection criteria.
The Authority will be considering Contractors turnover as a Pass / Fail criteria.
You will be required to demonstrate and evidence that the estimated GBP1.5 million value of this yearly contract, should not exceed 50 (%) percent of your previous annual turnover for the last 3 years i.e The Authority would be looking for a contractor to have a turnover of at least GBP3 million for this GBP1.5 million pound annual contract which = 50%.
When considering a response to this question, the Authority requires you to answer the question in full as stated within the PQQ documentation. In order for you to therefore identify if you will be able to Pass this question, the Authority has provided you with the financial turnover threshold requirement, which you will need to meet. Therefore your turnover as a company over the past three years must meet this threshold level.

Pre Qualification for: Operation and Management of Household Waste & Recycling Centre/Transfer Station (HWRC) at New Inn, Pontypool, NP4 0LS
The Authority reserves the right to reject any questionnaire received after the deadline.
The procurement process will be carried out inline with the Authority's Standing Orders for Contracts whilst also following best practice principles of the EU Procurement Directives.
The PQQ is the first stage of the procurement process and is designed to provide the Authority with the information required to define a short-list of suitable contractors.
In order to proceed to the next stage of the process (Invitation to Tender), organisations need to satisfy the Authority in terms of Contractor Acceptability, Economic Financial Standing, Capacity and Capability, Management, Equality Questionnaire, Sustainability and Health and Safety.
Contractors must pass all questions as set out in this PQQ, which are described as “pass/fail”.
Those contractors that fail any such questions will not be considered further and will be deselected from taking any further part in the procurement process.
Those who pass all the relevant “pass /fail” questions as identified in the evaluation matrix will then be assed upon the scored response questions which are also set out the same matrix.
Where questions are marked as “scored”, they will be scored between 0 and the maximum mark of 10 in line with the Scoring Matrix Methodology Model set out in this PQQ. Note if you score 0 (Unacceptable Response - Scoring Matrix Methodology Model) against a “scored” question then your PQQ submission will be deemed as a failed response and the PQQ will not be considered further.
A total contractors score will then be added together for each scored question to give a total score out of 100%. Following this process the Authority will produce a short-list of successful contractors whereby all contractors will be ranked according to the marks they achieve against the questions described as ”scored” in the Evaluation Matrix.
The top five contractors following the undertaking of the evaluation scoring matrix will then proceed to the Invitation to Tender (ITT) stage of the procurement process when taking into account the scored percentage elements identified in the evaluation matrix. More organisations may be taken through to ITT stage.
If any contractors are tied at fifth place then those contractors will also proceed through to the Invitation to Tender stage of the procurement process.
All other selection criteria set out, as ‘Information Only’ will be used to gain a broader understanding of the contractors business and assist in supporting the evaluation of the pre- qualification process.
In regards to Health and Safety, if successful in passing through to the ITT stage you will be required to complete a Pre-Tender Contractor Evaluation Health and Safety Questionnaire. If any sub contractors are involved in the delivery of this contract, then you will also be required to complete the Sub Contractors Evaluation Form.
All contractors will be advised of their evaluation status and those short-listed will receive the Invitation to Tender documentation.
Any queries must be received by 02 May 2014. If relevant/appropriate, answers to queries will be anonymous and circulated to all potential bidders during the PQQ process. This process will also apply at the Invitation to Tender Stage.
It is the applicant’s responsibility to ensure that all information required is supplied and accurate. Any changes that could affect any of the answers contained within this questionnaire must be notified to the Authority as soon as reasonably practicable.
The Authority shall not be responsible for any costs, charges or expenses incurred by contractors and no liability is accepted for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed. The Authority reserves the right to not award any or part of this proposed contract.
Contractors are advised that the Authority is subject to the Freedom of Information Act 2000 (the Act). If a contractor considers that any of the information supplied as part of this procurement procedure should not be disclosed because of its commercial sensitivity, confidentiality or otherwise, they must, when providing this information, clearly identify the specific information they do not wish to be disclosed and clearly specify the reasons for its sensitivity.
The Authority shall take such statements into consideration in the event that it receives a request pursuant to the Act, which relates to the information provided by the interested party. However, if the information is requested the Authority may be forced to disclose such documentation, irrespective of a contractors wishes. The Authority has identified some community benefit outcomes, which it is seeking to achieve in respect of this Contract, through working in partnership with providers to deliver positive outcomes. The successful contractor will be expected to consider opportunities to recruit and train long term economically inactive persons as part of the workforce delivering this project, and contractual obligations and/or performance indicators may be introduced to this effect.
The Contracting Authority considers these outcomes to be proportionate and relevant to the subject matter of the contract.
Should your organisation successfully proceed to ITT stage, as part of the tender response you will be required to submit a Delivery Plan, setting out how your organisation will deliver ‘community benefits’ through the Contract.

Precise information on deadline(s) for lodging appeals: The Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. Applicants who are unsuccessful shall be informed by the Authority as soon as possible after the decision has been made as to the reasons why the applicant was unsuccessful. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order for any document to be amended and may award damages, make a declaration of ineffectiveness, order for a fine to be paid, and/or order the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
